TERMS & CONDITIONS - THE BASICS
This Terms of Service (the “Terms”) describes the rights and responsibilities that apply to your purchase made on landanskylar.com, the use of Landan Skylar’s websites, services, and mobile app (collectively, the “Service”), each owned and operated by xyz.moda ltd. (“Landan Skylar”, “we”, “our” or “us”).
Please read the Terms carefully before using the Service. If you don’t agree to the Terms, as well as Landan Skylar’s Privacy Policy (the “Privacy Policy”) and Landan Skylar’s Community Guidelines (the “Community Guidelines”), you may not use the Service. If you are entering into the Terms on behalf of a company or other legal entity, you represent that you have the authority to bind such entity to the Terms. If you do not have such authority, you must not accept the Terms or use the Service on behalf of such entity. The Service is only available to you if you have entered the age of majority in your jurisdiction of residence and are fully able and competent to enter into, abide by and comply with the Terms.
REFUND POLICY
Collectors WILL receive the artwork they purchased and All Sales are final, there are no refunds, exchanges or cancelations. Request for edits or changes to Artwork purchased may NOT be made. All works of art purchased are frameless nor are accompanied with any hanging apperatise. Judgment of the Artwork presentational framing is left souly to the purchaser and good taste. Any disputes or issues regarding a purchase of artwork made will be remedied in friendly negotions in the confidence on case by case. We want you to be thrilled with your collected artwork.
SHIPPING POLICY
Shipping Costs are included in the price of the Purchased Artwork. Art works are carefully packaged and shipped at the most economical cost from the Art Studio, from the Artist. In the case of damaged artwork during shipment, a photographic documention of the damage works is required. Depending on the level of damage, based on the clear evidence of damage, either a restoration or a completely new painting will be offered which will be negotiated and agreed apon by the artist and collector. Shipment world wide where-ever route services have access to.
MEMBER SIGN-UP
If you create an account on the Service (your “Account”), you are responsible for maintaining the security of your Account and all activities that occur under your Account. You must not describe any misleading or unlawful information or fabrications, to cause Landan Skylar any liability. You must immediately notify Landan Skylar of any unauthorized uses of your Account or any other breaches of security. Landan Skylar will not be liable for any acts or omissions by you, including any damages of any kind incurred as a result of such acts or omissions.
EMAIL INSIDER
For purposes of the regular email marketing is for true collectors having a heads-up to secure new works before the general public. Both Fans (99%) and collectors (1%) are more than welcomed to receive frequent updats, even if you never purchase any art from Landan Skylar. You will not be email spammed, but instead notified of regular painting releases. You may unsubscribe an anytime, with no pressure to remain on the emailing list. Your email and personal data will not be sold to any third parties. The advantage of being on the email list is that purchases can be notified before social media posts which is important to key collectors.
PAYMENT POLICY
For purchases of any Artworks, you agree that our third party payment gateways, such as Stripe and Paypal, may store your credit or charge card or other payment information when purchasing the Art piece. You expressly agree that we are authorized to charge you (i) the fee for any applicable purchase for which you have made, billed apon the date of purchase, (ii) If the credit or charge card you provide expires and you do not provide new credit or charge card information or cancel your purchase, you authorize us to billing you and you agree to remain responsible for any uncollected fees for artwork already purchased and shipped. Patial payments and/or instalment payments are not accepted because of the price point value.
For purchases made (each, a “Paid Account”), Landan Skylar deems the person under whose name appears on the credit or charge card or other payment method that pays the charges for the Service to be the owner of the said Artwork. If a corporate or other organization’s name appears on the credit or charge card or other payment method, that corporation or organization is deemed to be the owner of the said Artwork. If any dispute arises as to who owns or posseses the said Artwork, you will be responsible to provided Landan Skylar a written confirmation from the Paid Account email address confirming a change in ownership of said Artwork.
Works purchased may be resold on Secondary markets and must not be sold within the first 3 years from the time of the Primary purchase. As part of regulatory ethics and controlling the said artwork transactions of value, location, ownership, it is required that that the Artist is informed in writing of the life-trail of the Artwork made. Failure to notify, or meet the required standard, or any suspicious transaction of racketeering, will result in a placement on a black list.
